The Health & Safety at Work Regulations state that where workplace risks cannot be removed completely, you have a legal responsibility to ensure these risks are clearly identified.

You have a responsibility to advise of any actions that must be taken to avoid any risks.

Failure to comply is an offence and you will be liable for prosecution. If an accident occurs as a result of a neglect of your Health & Safety responsibilities you may be held personally responsible.
